The chamber court has upheld the bail granted to former Superintendent of Police (SP) Babul Akhter by the High Court in the murder case of his wife Mahmuda Khanam Mitu. As a result, there is no impediment to his release, the lawyers said.

Former Superintendent of Police Babul Akhter was granted bail by the High Court last Wednesday after spending nearly three years and seven months in prison. Mitu's father Mosharraf Hossain later appealed to the Appellate Division of the Supreme Court to cancel his bail.
On August 14, SP Babul Akhter applied for bail in the court of Chattogram's Third Additional Metropolitan Sessions Judge Md. Jasim Uddin. Later, the judge rejected his bail and issued an order on August 18.
Regarding this, on the morning of June 5, 2016, Mitu, the wife of the then Chattogram Police Superintendent Babul Akhter, was shot and hacked to death while she was going to drop her son to the school bus at the GEC intersection in Chattogram city. .
SP Babul Akhter was transferred from Chattogram a few days before the incident. The murder took place in Chattogram shortly after he went to join his work in Dhaka. After the DB Police could not make any headway after investigating the incident for three and a half years, the Police Bureau of Investigation (PBI) took over the investigation of the case on the orders of the court in January 2020.
Then in May 2021, the PBI said that his wife Mitu was killed as a 'plan' of Babul Akhter. And for this, Babul 'also gave Tk. three lakh to the killers through people'.
Later, the final report was submitted in Babul's case and Mitu's father filed another case. However, after the case filed by Mitu's father did not survive the court, Babul's case was revived. Babul was arrested by the PBI in May 2021.
On September 13, 2022, the PBI submitted a charge sheet in the case to the court. Babul and seven others were named as accused in it.
Then, on October 10 of that year, the Additional Chief Metropolitan Magistrate's Court of Chittagong accepted the charge sheet.
On April 9 last year, the testimony in the case began with the testimony of Mitu's father, former police officer Mosharraf Hossain.
The case is currently pending in the court of Third Additional Metropolitan Sessions Judge Jasim Uddin of Chattogram.
Out of the 97 witnesses in the case, the testimony of a total of 52 people, including Mitu's mother Shaheda Mosharraf, has already been completed.
Babul Akhter had applied for bail in the Court of Third Additional Metropolitan Sessions Judge of Chattogram on August 14. When the judge rejected it, his lawyers went to the High Court.
